The onset of justice, only an illusion!
Hi!
Lot of you helped me in the process of getting justice but may be disappointed with what's out in the Times of India article today. Here is my side of the story. You can read it in continuation of my previous posts here.
On Wednesday (Oct 5), I received a call from Dy SP Krishnappa who told me that they had received my complaint through the DIG Railways (N Shivkumar). I was asked to come in. I left office immediately along with a colleague (Sanjay Pathak) and reached his office before noon. The Superintendent of Police (Railways) and the DSP asked me to explain the entire incident, which I did.
They then took me to Sr. DCM Gagarin's cabin who was present along with DCM Anwar Hussain. They weren't aware that I had been asked to come there and hence questioned me as to why I had come there. The presence of the electronic media seemed to disturb them. I was told that there would be an identification parade followed by a confronted enquiry, after which appropriate action would happen.
Thereafter, DSP Krishnappa asked me to break for lunch and see him at his office. I did so. He along with two sub-inspectors then took me to the Platform and asked me to show them the different locations I was taken to during the episode.
After this they formally lodged an FIR at the Chief Inspector of Police's office on Paltform 6. I was told that the FIR would be followed up by Inspector Mallesh.
They also asked me to wait while they would document the crime scene in a report format. It took three and a half hours for the same to be scripted in a local language, and finally at 8:30 PM I left for home. On returning home, I received news from the electronic media that 6 officials had been suspended.
On Thursday (October 6), I was called for the Identification Parade at 3 PM. I was accompanied by Sanjay and my organization's HR manager, Indraneel. During the parade, I identified the TCs who had manhandled me - Mr. Venkatesh, Mr. Nagaraj and Mr. Shivanna. I also identified 4 RPSF staff - Head Constable T K Mani, Constables - Jagjivan Ram, Meena, V V Pandey. They themselves clarified that there was an RPF staff by the name of Umesh who was also present. Each of them was asked to submit a statement. While the identified TCs submitted their statements an hour and a half later, the RPSF guys said they would do so the next day. DCM Anwar Hussain told me that the guys who had been identified were the ones who had been suspended and that the identification process was to cross-check. Finally, the process ended at 8:15 PM after which I returned home. I was asked to be present the next day at 11:00 AM again.
On Friday (October 7), the enquiry process started at 11:00 AM as scheduled. The enquiry was being conducted by DCM Anwar Hussain. I reached the location with my colleague again. First, the RPSF staff were called in one by one and questioned. All of them had a common written statement which said that neither did I misbehave nor did they touch me on September 30. Each of them said that they had nothing to add in person apart from this. All the written statements were of the same handwriting. At the end of their enquiry, each of them met me outside the DCM cabin and expressed regret at what had happened. They were extremely friendly, and asked me to put an end to the case as they had already received a suspension.
Then, the TCs were called in. Obviously, their story was different. They claimed that I had not given a PF ticket, manhandled them thereafter and then I had beaten the RPSF staff. All of them said that they didn't see me being beaten up by the RPSF.
Hearing a bunch of lies repeatedly was frustrating but then they were never going to speaking the truth in any case. A few independent witnesses were called in - one from KSTDC office on Platform 1 who said that he didn't see a thing but had seen a crowd collecting nearby. The cloak room chaps were then called in and they claimed that they didn't see a thing as well. Just before the day would end, there was an employee of Satkar restaurant who personally had called the DCM and said that he was present at the scene. He said that he saw me having a squabble with the TC while he had come to the Nandini shop to buy curd. However, after the TCs took me inside the cabin, he didn't know what happened. The enquiry ended at 9 PM.
On Saturday (October 8), I was called in again at 11 AM. I deposed before DCM Anwar. Having troubled my friedns enough, I went in alone. During the enquiry, DCM Anwar cross-checked the purchase of my PF ticket by placing a call to my fiancee while the enquiry was on. I had also pointed out that while dropping my fiancee and her mother, there was a chap who had come to drop a couple in the adjacent seats, and that chap could be traced and called because he had seen me giving the PF ticket to the TC. DCM Anwar told me that was not required as he had already found the accused guilty through contradictions in their statement. He then asked me to accompany him to the crime scenes. Thereafter, he asked me to show him my bank account details to confirm withdrawal of money. I did that too. We even traveled to the ATM inside Majestic to check whether the first claimed withdrawal of money matched. And it did. The enquiry then ended at 5:30 PM.
Throughout the enquiry process, DCM Anwar had been extremely supportive in his mannerisms and on my part I kept my commitment of not speaking to talk to the media. He told me that while it was quite a ordeal to come in every day, he was happy that I hadn't left things midway. While leaving, he told me that strict action would be taken in 4 days and he would call me personally and inform me about it.
Later that night at 9:30 PM, I received a call from DCM Anwar asking me to come in again as they had achieved some kind of breakthrough. On reaching the location, I found that they had nabbed the fraudster V Srinivas. He was found at the platform again by one of the RPSF constables who was present on that day. After I identified him I was asked to go to the police office in case any questioning was required. Everyone seemed to be extremely happy at the arrest of the fraud chap and the police told me that I should come again the next morning at 10:00 AM for further police enquiry. While leaving, the RPSF guys and TCs personally met me and told me that they were sorry for their action. They told me that the fact that they themselves hunted down the fraudster was testimony of them wanting to make amends. In fact some of the RPSF guys and one of the TCs (Nagaraj) even hugged me. I too was extremely happy that the case was being handled so well.
I returned home at midnight. I narrated the developments to my roommate Amit. After a small discussion, both of us were of the opinion that the truth had prevailed. I felt good about myself that my efforts had born fruit. I updated my dad about the entire episode. He told me that if the TCs and RPSF guys who had abused me the other day were now sorry for their actions, then that I had done my duty. The strong fight back and the strong forgive, while the weak do neither. After this bit of conversation I too felt that if I talked to all of them once and if they were committed towards being better humans now, then that would be a much better outcome than damage being caused to their career.
Later, I sent an SMS to the DCM saying that after all the prompt enquiry and action, my anger/frustration against the railways had finally vanished. He replied saying that my anger was misplaced. I told him that despite what had happened I would like to meet the the TCs and RPSF staff and talk to them once. He said he would arrange for the same.
The next day, Sunday (October 9), I reached Inspector Mallesh's office along with my roommate Amit. They needed my statement again and the process took a couple of hours. Again, RPSF staff member V V Pandey and T K Mani came and talked to me like I was their younger brother. It made me feel good.
Then on Monday (October 10), DCM Anwar called me in continuation of the previous SMS exchange. I told him that from their behaviour I felt that they were sorry about what had happened. He told me that they were indeed sorry and asked me to come down to his office and talk to him in person. Inspector Mallesh had also called me in separately. So after finishing office at 6:30 PM, I went down to meet DCM Anwar. As always, he was extremely supportive. He had been receiving several calls asking for an update on the case. I expressed my frame of mind to him. He said that if I withdrew the complaint, he affirmed my belief about it being a proactive contribution towards making Southern Railways a better organization. Thereafter, I wrote a letter which said that the accused railway officials are indeed sorry for what happened and they are now committed to being better people, and hence I wouldn't like any further damage being caused to them. Hence, I was withdrawing my complaint. DCM Anwar and I then shared a conversation over a cup of tea.
The same message was communicated across to Inspector Mallesh. He too reaffirmed my faith in the system and was pleasantly surprised at my step. He too shared a glass of flavored milk at the station after which I left.
I thought everything was over and done with as far as the railway chaps were concerned till today's article in the Times of India, wherein the DRM Mahesh Kumar has manipulated my words. The article which has quoted him claims that I withdrew the complaint because the enquiry found me at fault on several fronts. God dammit, if that is the case, then please convict me.
On reading the article I immediately sent a message to DCM Anwar with a word of thanks for such a nice way of thanking me. As expected, there was no response.
I thought that what I had done was an act of good faith. But it's been rehashed very conveniently. May God bless them all!
For those who have been with me through this, even if it's about just reading this post - A big thank you for your contribution. I am overwhelmed by the support. I apologise again for the inability to communicate on a regular basis.
Time to move ahead with the better things that life has to offer. Injustice can indeed be poetic!

Am brinda from Chennai and have been following your case very closely. I really fail to understand, why like your first post, you couldnt post this on Ryze. Your case is a reminder to us that however much we think justice will prevail, there is always a backdoor. Anyways proud of you to have stood your ground. All the best!

You probably learnt the lesson that you should NEVER withdraw a case after it's gone to the media. I see where you came from, but you're in no way obligated to withdraw a case: they must present you with a written apology and/or a media interview saying that they are sorry and only AFTER that, you could consider withdrawing.
Unfortunately, now there's no way for you to explain away what's been said of you. If you have any written proof of the fact that they were sorry (other than your own letter) please do bring it out.

It's sad that it had ended this way but if the guys who manhandled you are really regretful and realized what they did was inhuman, i guess you have succeded in this case.

Don't let this off now or you will be remembered as the drunk fellow who beat up some railway officials and made a huge fuss of it. You can file a case of defamation against DRM Mahesh Kumar and DCM Anwar and inform the media. Don't let it go now, not after this long.

Though things have ended up on this note, I am very much proud that a single person dared to stand up against the system. Your words were heard and brought out by media, dont know how many gross acts just go unheard.

all u can do now is file a suite against railways and tell them to prove that u were guilty

I did not know your story at the point of writing this email. I am just reacting to what was is published in TOI. I still lean towards believing you and not what the Railway official version is.

I happened to read a news item in The Times of India, Bangalore Edition, Page 3 where it is mentioned that you have taken back the charges against the Railway officials because you could not substantiate the claims. I am aghast at the statement that you were in inebriated state, you did not have a valid platform ticket and it was you who started the fight. Although I am not an authority to pass any kind of judgement, I would still like to apologise to the Railway officials for not trusting them and that too without hearing their side of the story. Now, you owe an explaination to the Software Engineering community who went out of their way in supporting you. To those people who really did something, and to those also who were cheering you all the way without you knowing about it. Please come clean, Mr Adani, and own up if you are the one at fault.

Totally agree with you, why would the railways transfer/suspend their officials if they were not at fault ?? goes on definitely to prove Nimish's point.
This is really sad Nimish that you're being manipulated to save railways image, but kudos and thanks for putting up such a fight which did help achieve its means to quite an extent. If nothing then this case would definitely make these goons think twice before attempting a similar act again.

We all knew what the result of this case would be ... After all, we are also indians. But I was a little worried that you might be troubled by these so called political leaders and railway biggies. Happy to hear that you have withdrawn the case and possibly in a safe position now. But better be careful as we may think everything is over, but someone might still be waiting for you ... This is just a word of caution.
Whoever find the coverage by ToI to be unjust (they could have taken Nimish's view of it before publishing), it would be great to write to them and let them know!

Proud of your efforts. Dont feel bad about what happened in the end. I liked the fact that railway authorities got an indication that they cannot cheat a person like that. Still if you feel that some more truth needs to come out then I am always with you.

Well done.. please dont leave them now ... i have already sent a mail to TOI. My brother is also from IIML, and i know you are right. Those cheaters should be punished. I am sure india has reached a point of so much corruption that such people should be stripped and made to run in the public anyways they have no shame, you cannot do anthing to harm them they are shameless animals.

Did you actually think that if you acted with a good heart, you can actually turn this crooks into angels? be realistic mate. They went for the kill when they saw you. And you gave up everything when the end was in sight. I dont know what to say man. I am sure all of us would have felt it as a personal victory if you had succeeded in nailing those bastards. I have been following your case quite closely and dissappointed a lot with the outcome. Why do you think that courts punish crooks? Why cant they just believe every crook who says they are sorry and release them? THink over it man, and I hope that you go ahead with your complaint and take this issue to its logical end - GET THOSE BASTARDS TO ROT IN JAIL !

It was foolish to withdraw the case before at least a public apology, when you had sone so far. I know it is difficult for a single person to fight against the system, but you had gone almost to the finish line.

Kudos to you for putting up a brave fight against the system.
Its really sad to learn that things have turned out this way, but, I feel, this should not be THE END. The agony which you have gone through is understandable and the toll it must have taken on you and your family is irreplacable.
Still, if possible, don't let the matter close on this note. You cannot let the people who harrased you be happy like this. Turn the tables upon them by, as jace said, filing a defamation suite. I know its easier said then done, but the finish line is yet to be reached.
I remember a quote in Hindi, 'akela chana hi bhaad fodta hai' .

We get your message and are proud of you. The railways and the Indian systems are like what they are but if we have 10 more like you then we can expect a change pretty soon. You should take this to the court now as thats the last place where you can expect justice from..

Having taken it this far, I think it does not make sense for you to back out now as the "person who started the scuffle". I think you should not have gone in for the complaint in the first place. It give credibility to a system that does not have it. Its like voting in an election. Before you clean up the act you need to first prove that it is a sham.
I am not suggesting (like the others) you sue the railways or anything. But make sure that your story stays RIGHT HERE. Do what you have to do FROM YOUR OFFICE. Keep the story alive and ensure that it is THEY who react and you HOLD THE INITIATIVE.
Backing out now will only brand you and ensure that all the atrocities of the railways will go UP. They will simply point out this case everytime ANYTHING comes up.

Go to Delhi,Mumbai,Pune or Hyderabad. Leave this behind.

The real reason for the accused railway staff to be so nice to you was exactly this... To lull you into a false mood and make you withdraw the case. You can well imagine the amount of money these guys must have spent on greasing the police so that the situation could be resolved to their advantage.
People have suggested that you follow up with a court case against the railways for defamation etc., but I would ask ab lakeer peetne se kya hoga, saanp to nikal gaya...
Anyways, I wish you all the best to put this behind you and move on. Life is all about such experiences and surely there are a lot more joys forthcoming.

I could NOT believe that such serious fraud could be committed and that too by so many people in our country
Reading your post, and contemplating on the many issues there, I feel your readers should know the dark side of Indian Marriages, especially the misuse of laws by Indian wives these days. The resultant injustice to Indian men and families is enormous
Do you know that 1000s of innocent Indian men are being victimized by the misuse of anti dowry law - a particular Section 498A of Indian Penal code ?.
Many newly wed wives unable to adjust with their husbands, some who are unable to live in a new environment and even greedy Indian wives are known to file FALSE dowry cases against their husbands and In - Laws. They falsely accuse their husbands' of treating them with cruelty AND demanding dowry during marriage.
Since dowry is legally prohibited and severely punishable in India, many of these newly married men stand the gruesome prospect of being arrested and thrown into and Indian prison ... for years !!
The intention of these Indian wives of course is to settle scores or extract money from their in laws.
Once a dowry case is filed the Indian police are forced to arrest the husband and in some cases, even their un suspecting parents & sisters are arrested and jailed. Unable to bear the insult some have committed suicide.
As most of the male victims would be innocent and would not have EVEN stepped into a police station, let alone be arrested, they are forced to NEGOTIATE AND PAY these women
Section 498A of the Indian Penal Code is badly lacking the "..due process of law .." i.e. Under any normal legal process, an accused is considered innocent unless proven guilty. However under Sec. 498A - I.P.C., the accused is immediately assumed to be guilty and has to loose liberty immediately....
There are 1000s of victims all over India
It is reported that ".......In Andhra Pradesh (one of the Indian States), for example, a third of all the pending cases related to “atrocities on women” as on June 30 2005 are those under sections 498 and 498(A). In the first six months this year, 3801 new cases under just these two sections were instituted..........."

It was the The Times of India's responsibility to publish your statement along with the DRMs. That's an injustice too. The indifference that you see in the administration is also evident in the editorial policy in this case.
As far as witdrawing the case was concerned, it was a big mistake even if your intentions were good. You were manipulated into believing that these men were repentent. Most of them as good as criminals themselves. That's the reality. We live in a brutalized society.

I am in total appreciation for whatever you have done to bring such brutalities to light. I am sorry that the case ended in such a bad way. While I was reading along, I felt like I was reading some bollywood cinema story, and now I believe that the stuff they show indeed happen in reality!
In any case, we have learnt some good lessons from you.
1. Dont just sit there and brood over the injustice happenned to you. Gather courage to confront them in the face and also let the world know about it.
2. Never get into the trap of sweet-talk. Go ahead and let the offender pay for his offense no matter how sorry he feels about what he did.
On an other note, not all police are bad like this. An incident that hapenned with me made me change my opinion about Indian police towards better. I am gonna post it my blog today.
